SELLER and BUYER shall be referred to individually as “Party” and collectively as “Parties”.
- SUBJECT OF THE AGREEMENT
The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and performance of the products or services, the qualities and sales prices of which are specified below, that the BUYER orders electronically via the estore.hubek.com.tr (“Site”) website. This Agreement has been prepared in accordance with the provisions of the Consumer Protection Law No. 6502 and the “Regulation on Distance Contracts”.

BUYER accepts that he/she has read, understood and electronically approved all information regarding the basic characteristics, sales price, payment method, performance/delivery conditions of the contracted products/services.

During the ordering phase, the BUYER checks and approves the product/service and payment method he/she has chosen. The BUYER confirms that all information specified on the order creation and payment page is correct.
- GENERAL PROVISIONS
- Preliminary Information and Approval of the Agreement
- BUYER accepts that he/she has placed an order after reading all the preliminary information regarding the basic characteristics, sales price, payment method and delivery/performance information of the contracted products/services on the Site and electronically approving this Distance Sales Agreement.
- Order Process and Payment
- BUYER makes the payment by selecting one of the payment methods specified on the Site.
- The protection and secure processing of credit card/bank card information is provided by third party payment service providers that comply with international security standards.
- Delivery and Performance Conditions
- Physical Products: It will be delivered to the address specified during the order, via the cargo company, within 30 (thirty) days at the latest (except for force majeure reasons).
- Education or Event Services: SELLER informs BUYER about the relevant training/event date, place and scope. BUYER will be able to receive the service/event on the specified date or on the calendar announced by SELLER.
- Right of Withdrawal
- General Rule: BUYER has the right to withdraw from the contract within 14 (fourteen) days without giving any reason and without paying any penalty.
- Exceptions:
- If the performance of the service starts with the BUYER’s approval before the expiration of the right of withdrawal (for example, instantly accessible online training), the right of withdrawal may expire.
- Flight ticket, accommodation, entertainment/educational event reservations, etc. In exceptional cases listed in the law, the right of withdrawal may not be valid.
- In order to exercise the right of withdrawal, it is sufficient for the BUYER to send the notice of withdrawal to the SELLER in writing or via a permanent data storage device.
- The product/service fee will be refunded to the BUYER within 14 (fourteen) days after the notice of withdrawal reaches the SELLER. If the product is to be returned, the BUYER must ship the product with all accessories, invoice or delivery note to the address specified by the SELLER.
- Other Returns and Exchangesim Conditions
- In physical products, when damaged or defective goods are delivered, the BUYER must immediately notify the SELLER. The BUYER may use the optional rights specified in the law depending on the nature of the defect (exchange, repair, refund, etc.).
- Cancellation/change conditions for education or event services may be arranged separately in the special conditions of the relevant program/campaign. This information is provided to the BUYER during or before the ordering phase.
- Legal Notices and Liability
- The BUYER is responsible for the accuracy of all personal and contact information entered during the ordering process. SELLER cannot be held responsible for additional costs or delivery problems that may occur due to incorrect or incomplete information.
- SELLER reserves the right to change prices and content due to typographical errors or updates on the Site.
- Force Majeure
- In cases where the parties develop outside their control and prevent the performance of the contract, such as natural disasters, epidemics, war, terrorism, strikes, and states of emergency, the parties’ obligations are suspended. When the force majeure is eliminated, the contract continues to be performed; if performance becomes impossible, the contract may be terminated.
- Competent Court and Dispute Resolution
- Consumers may apply to Provincial or District Consumer Arbitration Committees and Consumer Courts regarding their complaints and objections.
- For matters not regulated in this Agreement, the provisions of the relevant legal legislation (Law No. 6502 on the Protection of Consumers and Regulation on Distance Contracts) shall apply.
- ENFORCEMENT
The BUYER declares that he/she has read, understood and accepted all the terms of this Agreement by marking “I have read and approved” before any purchase or reservation made on the Site. This Agreement shall enter into force on the date it is approved electronically by the BUYER.
